By purchasing any of our design products and services you are purchasing the right to display the material with all credit links remaining intact on ONE website only. Creating Ambiance retains all copyright privileges on all images and designs unless we use an image that is copyrighted by an outside source such as a stock image. You DO NOT have permission to use our Website Templates or the graphics therein for other purposes such as print work, products for resale, license or any online sites such as eBay, blogs, etc. whether physical, digital or electronic format.
All Website Templates (files, images/graphics) are copyright protected by Creating Ambiance and may not be shared, rented, resold, distributed, transferred or posted across a bulletin board, network, modem, internet, or web page. Do not make copies of these files on any electronic or physical medium (including CDs, diskettes or other storage medium) for any reason other than for back up purposes.
Under no circumstances can the credit line/logo which is linked to Creating Ambiance to be removed. Our graphics and templates may not be altered without our written permission and you may not combine our graphics with another designer’s graphics nor can they be shared, rented, resold, distributed, transferred or posted across a bulletin board, network, modem, internet, or web page. Do not make copies of these files on any electronic or physical medium (including CDs, diskettes or other storage medium) for any reason other than for back up purposes. Each of our website templates and the images used therein are LEGALLY COPYRIGHTED AND LEGALLY REGISTERED. It is your responsibility to make sure that our link credit stays on the site with the design. There is no option for not displaying the link on every page of your website that contains any of our templates or images/graphics. For any site in violation of this policy we reserve the right to remove our template from your website until the credit link is restored. If you refuse to restore the credit link and we are unable to remove the template then the template will be relisted for resale as a limited edition and be sold multiple times.
All content (text, product images, etc.) added to your website are copyright protected by you as owner of that website. Under no circumstances will Creating Ambiance be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from client’s website sales or lack thereof. Client is responsible for adding their own content text and products and promoting their own website.
Due to the digital nature of our design services, we are unable to issue refunds. There are no exceptions to this policy as our time and work cannot be refunded to us. By purchasing any design, ready-made or custom, you are agreeing to this policy and you will have to check a box in the shopping cart noting your agreement to this policy and all of our policies before being able to complete check out. Custom Designs are put on our schedule after payment is made. Template will be designed according to client's specifications and a sample will be presented to client for feedback. If at any time client fails to respond to emails for a period of over four weeks client will be deemed to have abandoned project and the project will be closed and taken off of our schedule and no further work will be made on the project and no refunds will be given. If after that period of time client contacts us and wants to resume work on their project then that project will be deemed an entirely new project and the client will be charged accordingly and once paid the client will be added to the bottom of our schedule to wait their turn again.
Payment is due in full before work on any website template or matching item commences. In the case that extra revisions are to be made which are not included in the terms of your product as posted in description of said product, payment for these revisions must be made before revisions will be made. Any final payment is due before the project is finalized and sent or before any template is uploaded to your site.
The designer for your template or print work shall make every effort to ensure the final product is free of any errors before submitting any final product to you. It is the client’s responsibility to proofread and ensure that there are no visible errors contained in the final product. Once you have approved the final product the designer is not responsible or held liable for any errors after the final product has been committed to print or posted in view of the public. Any errors or technical problems with a design or website template must be reported within 30 days of completion of the project. After that 30 day period fees or an hourly rate will be applied to any revision. This does not include revisions in how a template “looks” (technical errors only) – any redesign requests will be charged at an hourly rate any time such request is made after your template was approved by you and loaded onto your site.
Creating Ambiance respects your privacy and we are committed to continuously protecting your privacy. Your information will never be shared or sold to any other entity ever. Your payment and personal information is always protected on our Secure Sockets Layer (SSL) software. It is the among the best software available today for secure commerce transactions and all information is encrypted including credit card number, name, and address, so that it cannot be read over the internet.
